Terms of Service

1. Agreement
By creating a NodeRush account or using the NodeRush service, you agree to these Terms of Service. Shimul Holding B.V., trading as NodeRush ("NodeRush", "we", "us"), provides cloud computing infrastructure services subject to these terms.
2. Service description
NodeRush provides virtual private servers (VPS), Windows Remote Desktop Protocol (RDP) nodes, and related infrastructure services. Plans are billed monthly by default, with optional on-demand hourly billing available at a higher rate, as displayed in the pricing configurator.
3. Account responsibilities
You are responsible for maintaining the security of your account credentials and for all activities occurring under your account. You must notify us immediately of any unauthorized use. You must be at least 18 years old to use the service.
4. Acceptable use
You may not use NodeRush to: send unsolicited bulk email (spam); conduct DDoS attacks or port scanning against third parties; host child sexual abuse material; mine cryptocurrency without explicit written consent; circumvent any security or access controls.
5. Billing and payment
Monthly plans are billed in advance for each billing period. On-demand plans are billed hourly in 60-second increments at the higher on-demand rate shown in the pricing configurator. Payment is due upon invoice issuance. Accounts more than 7 days past due may be suspended. All prices are in USD and exclusive of applicable VAT.
6. Service level agreement
NodeRush targets 99.99% monthly uptime for all nodes. If monthly uptime falls below 99.9%, eligible customers receive a service credit equal to 10% of monthly charges for each 0.1% below the target, up to a maximum of 30%. Service credits are applied to your account balance, expire 6 months after they are issued, and their value reduces by 3% for each month they remain unused.
7. Data and backups
Automatic snapshots are taken every 6 hours and retained for 30 days. You are responsible for maintaining independent backups of critical data. NodeRush is not liable for data loss resulting from customer actions, hardware failure, or force majeure events.
8. Termination
Either party may terminate the service at any time. Upon termination, your nodes and data will be deleted within 30 days. NodeRush may terminate accounts immediately for violations of the Acceptable Use Policy without refund.
9. Limitation of liability
NodeRush's total liability is limited to the amounts paid by you in the 3 months preceding the claim. We are not liable for indirect, incidental, special, or consequential damages, including lost profits or data.
10. Governing law
These Terms are governed by the laws of the Netherlands. Any disputes shall be resolved in the courts of The Hague ('s-Gravenhage), the Netherlands, except where mandatory consumer protection laws in your jurisdiction provide otherwise.
